Rohner (Seller) warrants to the original end-user (Buyer) that the equipment manufactured by Seller (equipment) and purchased by the Buyer from the Seller or Seller’s authorized Distributors (Distributor) and when installed, operated, and maintained per the Seller’s installation, operations and service manual shall be free of defects in workmanship for a period of (1) year or the lesser of 2500 hours of operation following the shipment of the equipment from the Seller. The warranty period for equipment purchased with field installation by the Seller or Distributor shall be for a period of (1) year or the lesser of 2500 hours of operation following completion of installation or the lesser of (1) year (3) months following the shipment of the equipment from the Seller. The obligation of the Seller and the sole and exclusive remedy of the Buyer shall be at the Sellers option:
1. Buyer may return the defective equipment component(s) to Seller’s for repair or replacement during the warranty period following a written warranty return authorization issued by the Seller. Buyer is responsible for all labor, shipping and handling cost associated with the return of the defective component. Buyer must prepay all return handling and shipping cost.
2. Buyer may purchase a new replacement equipment component(s) from the Seller and return the defective equipment component(s) to Seller for a warranty credit authorization issued by the Seller. Buyer is responsible for all labor, shipping and handling cost associated with the return of the defective component. Credits shall be issued at 70% of the new replacement equipment component(s) price less shipping and handling.
The Seller shall not be responsible for normal wear and tear associated with use of the equipment; improper installation of the equipment; equipment use other than intended by the Seller; or equipment modified by any persons or organizations. Seller offers no warranty for components manufactured or supplied by other persons or organizations, Original Equipment Manufactures (O.E.M.) and used as a component of the Seller’s equipment.
Sellers shall have the sole determination of the warranty claim and will issue a written acceptance or denial of each claim.
Immediately upon the Buyer’s discovery of a potential warranty claim against the Seller the Buyer shall notify the Seller in writing and discontinue use of the suspect equipment component(s). Buyer may not attempt to repair the suspect equipment component(s) without prior written consent by the Seller. All returned O.E.M. components are subject to an additional handling and restocking fee up to 20% of the new replacement price.
Disclaimer of Warranty- these are the only official warranty claims. No other person or organization can make modifications, deletions, or additions to the warranty neither in writing, expressed or implied including merchantability or fitness for a particular use.
All replacement parts replaced under warranty or purchased subsequent to the warranty period will be warranted for a period of 90 days.
Any actions by the Buyers against a breach in the warranties contained herein must be commenced with in (1) year after cause of action occurs. Seller’s liability shall not exceed the original Sellers price of the Rohner equipment involved in the action.
